Tiemen represents clients in complex and high-stakes disputes, often with a cross-border element. He has broad experience acting for private equity, corporate and banking clients in (post-)M&A disputes and other corporate and commercial disputes, both before the Dutch courts as well as in arbitration. Tiemen was previously seconded to Shell's Global Litigation group and has particular expertise in the energy sector.

  • Representing two listed corporate clients in civil follow-on litigation before the The Hague District Court and Court of Appeal flowing from alleged breaches of foreign antitrust laws.
  • Representing the offeror (an entity owned by funds managed by Blackstone) in Enterprise Chamber litigation brought by minority shareholders following the successful public offer for NIBC Bank.
  • Representing two global private equity firms in NAI arbitration relating to a post-M&A SPA dispute in the energy sector.
  • Representing Shell plc before the The Hague Court of Appeal in the climate change case brought by several NGOs.
  • Representing an international investment bank in a multi-jurisdictional case concerning an issuance of bonds and duty of care.
  • Representing several international energy companies in ICC arbitration relating to a post-transaction SPA dispute pertaining to the sale of an oil mining lease.
  • Representing Lucerne Capital Management in Enterprise Chamber litigation challenging the public offer for Altice Europe N.V., resulting in an increase of the offer price of more than 30%.
  • Representing the majority shareholder and offeror in relation to a public offer for a foreign dual-listed Dutch company in inquiry proceedings before the Enterprise Chamber against a minority shareholder.
  • Representing a global power company in NAI arbitration relating to the interpretation of certain long-term electricity sales agreements.
  • Representing an international investment bank in Supreme Court tax litigation on issues of Dutch tax law.
  • Representing various clients in their defense against allegations of greenwashing before the Dutch Advertising Standards Board (Reclame Code Commissie) and its appeals body.
