This year's Werner Pünder prize for best academic thesis/dissertation at Frankfurt's Goethe University on the subject "Freedom and Hegemony Past and Present" has been awarded to Yannic Hübner. The 30-year-old law student won the prize for his dissertation Rechtsstaatswidrig, aber straflos? Der agent provocateur-Einsatz und seine strafrechtlichen Konsequenzen (English: Unlawful yet unpunished? The use of the agent provocateur and its implications under criminal law) (Nomos Verlag).
The Werner Pünder prize is awarded by the university's association of friends and supporters. It is presented in memory of Dr. Werner Pünder, lawyer and staunch opponent of the National Socialist regime in Germany. He spent a number of years in prison after bringing a legal claim against the German Reich due to the death of a ministerial official during the Röhm putsch. In 1949, his son, Albrecht Pünder, became one of the founders of the German firm which preceded Clifford Chance and which established the prize in 1987 in memory of his father. The EUR 10,000 prize money is paid by Clifford Chance and Dr. Marie-Lise Weber, the widow of another partner who lent his name to that firm, Dr. Dolf Weber.
This year's winner, Yannic Hübner, studied law at Goethe University Frankfurt from 2010 to 2015 and is currently a research assistant at the criminal law specialists Kempf Schilling + Partner in Frankfurt. His dissertation examined the subject of the "agent provocateur" (state operatives who deliberately incite others to commit criminal acts). This controversial technique is still regularly used when investigating certain types of criminal activity. Among other things, the dissertation sets out a new approach for statutory provisions on this.
On 22 July, Yannic handed over copies of his dissertation to of counsel Professor Thomas Gasteyer at the Clifford Chance office in Frankfurt. As a long-time Clifford Chance partner, Thomas is a member of the award committee and responsible for organising the Firm's involvement with the Werner Pünder prize. Yannic, who did a placement at Clifford Chance during his degree, working with the Litigation and Restructuring teams, thanked Thomas for the award and the Firm's support.

Den diesjährigen Werner-Pünder-Preis für die beste wissenschaftliche Qualifikationsarbeit an der Goethe-Universität in Frankfurt aus dem Themenkreis „Freiheit und Herrschaft in Geschichte und Gegenwart" erhält Dr. Yannic Hübner. Der 30-jährige Jurist wurde für seine Dissertation Rechtsstaatswidrig, aber straflos? Der agent provocateur-Einsatz und seine strafrechtlichen Konsequenzen (Nomos Verlag) gewürdigt.
Ausgeschrieben wird der Werner-Pünder-Preis von der Vereinigung der Freunde und Förderer der Universität. Die Auszeichnung erinnert an den Rechtsanwalt Dr. Werner Pünder, der als Gegner des Nationalsozialismus in Deutschland für mehrere Jahre inhaftiert war, nachdem er eine Klage gegen das Deutsche Reich wegen des Todes eines Ministerialbeamten im Kontext des Röhm-Putsches eingereicht hatte. Der Sohn von Werner Pünder, Albrecht Pünder, gründete 1949 in Frankfurt die deutsche Vorgängersozietät von Clifford Chance, die 1987 zum Gedenken den Werner-Pünder-Preis stiftete. Das Preisgeld von 10.000 Euro tragen Clifford Chance und Dr. Marie-Lise Weber, die Witwe des früheren Namenspartners der Sozietät Dr. Dolf Weber.
Der diesjährige Preisträger Yannic Hübner studierte von 2010-2015 Rechtswissenschaft an der Goethe-Universität und ist derzeit als Wissenschaftlicher Mitarbeiter in der Frankfurter Strafrechtskanzlei Kempf Schilling + Partner tätig. In seiner Dissertation untersucht er das Thema staatlicher Tatprovokation. Die umstrittene Ermittlungstechnik gehört heute in bestimmten Kriminalitätsbereichen zum Alltag der Strafverfolgung, der Autor entwickelt dazu unter anderem einen Ansatz einer gesetzlichen Regelung.
Am 22. Juli überreichte Yannic Hübner im Frankfurter Büro von Clifford Chance Belegexemplare seiner Arbeit an of Counsel Prof. Dr. Thomas Gasteyer. Als langjähriger Clifford Chance-Partner gehört Thomas Gasteyer dem Preisgremium an und betreut das Engagement der Sozietät im Rahmen des Werner-Pünder-Preises. Hübner, der während seines Studiums unter anderem bei Clifford Chance tätig war und dabei die Strafrechts- und Restrukturierungs-Teams kennen lernte, dankte für die Auszeichnung und Förderung.
