Our Cybersecurity Handbook aims to help organisations understand and comply with the diverse and evolving cybersecurity regulations that affect their activities.

It provides an overview of the cybersecurity regulatory frameworks in the following jurisdictions, with a focus on key legislation, regulatory bodies and enforcement in each: Australia, the Czech Republic, the EU (overviewing EU-wide legislation), France, Germany, Hong Kong, Italy, Japan, Luxembourg, Mainland China, Poland, Romania, Singapore, Slovak Republic, Spain, Turkey, United Arab Emirates, the United Kingdom and the United States.

We are seeing a global trend towards increased cybersecurity regulation, often tightening existing requirements and affecting a broader range of businesses. While each jurisdiction's legal framework has its own specific features and areas of focus, there are common themes including increasing alignment with international standards, a growing focus on critical infrastructure protection, and a rising awareness of cyber risks among regulators, businesses and consumers.

Daniel Silver has over twenty years experience handling high stakes investigations and litigation. Dan focuses on regulatory enforcement and white collar criminal defense matters for both corporate and individual clients. Dan regularly represents clients in matters before the Department of Justice, the Securities and Exchange Commission, and other federal and state agencies. Dan frequently counsels clients on issues relating to securities fraud, sanctions, AML enforcement, and anti-corruption. Dan has also advised clients on cybersecurity issues including data breach response.

Dan is an accomplished trial lawyer. Most recently, Dan obtained an acquittal for the founder and CEO of a publicly-listed software company following a criminal jury trial in federal court in San Francisco. The case, which involved allegations of securities and accounting fraud arising from a multi-billion dollar acquisition, was touted by the Department of Justice as the largest fraud prosecution in the history of Silicon Valley.

Prior to joining Clifford Chance, Dan spent ten years as a federal prosecutor, serving in several senior leadership positions and as Chief of the National Security and Cybercrime Section within the United States Attorney's Office for the Eastern District of New York. In the U.S. Attorney's Office, Dan supervised a team of more than one hundred federal prosecutors and conducted more than a dozen jury trials.

Ling Ho has spent over 30 years advising clients on intellectual property related matters in the Greater China region. With over 20 years' experience in her legal career, Naomi has acted for clients across a range of sectors and industries on complex commercial litigation, class actions and regulatory investigations. She has experience litigating in the Federal Court and Supreme Courts of NSW and Victoria as well as in the Queens Bench division in the UK (being admitted as a solicitor in NSW and the High Court of Australia and in England and Wales). She has advised clients in parliamentary inquiries and follow-on litigation to such inquiries. Naomi is Co-Chair of the firm's global Class Actions and Group Litigation Group, Co-Chair of the Innovation & Best Delivery Committee for APAC and a member of the global ESG Risk working group.

Naomi previously worked for a top tier Australian firm, in-house at a global bank and in-house at a wealth manager. She has training and experience as a legal project manager and regularly integrates technology into her team's project delivery.

Naomi is highly regarded by clients for her technical skills and trial experience. Legal 500 recognised Naomi as a "Next Generation Partner" in 2023.

She earned her Masters of Business Administration from Warwick Business School, Warwick University, her Masters of Law from the University of New South Wales and her Bachelor of Laws (Hons) and Bachelor of Science from the University of Newcastle (with an emphasis on chemistry).
