Kenneth Tay is a Senior Associate in the Litigation and Dispute Resolution practice of Cavenagh Law LLP. He has particular experience in navigating disputes in the APAC region, including engineering, energy, construction, IT, insurance, shareholder, and post-M&A disputes.
Kenneth has represented clients in arbitrations conducted under, among other rules, the ICC, SIAC, HKIAC, and UNCITRAL rules. He also regularly represents clients in Singapore court proceedings, including before the Singapore International Commercial Court.
Kenneth sits on the Singapore Law Society's Alternative Dispute Resolution Committee and regularly delivers lectures, seminars and courses on international arbitration.
- Co-counsel with an Indian Senior Advocate in a US$ 900 million Delhi-seated ad hoc arbitration commenced by a customer of a wind turbine manufacturer in respect of allegedly defective wind turbines.
- Representing a multinational industrial conglomerate in parallel SIAC and ICC arbitrations concerning the offshore and onshore scope of contracts to supply equipment and services in connection with a coal fired power plant in South-East Asia. The arbitrations were seated in London and Singapore.
- Representing respondents in a US$ 500 million post-M&A SIAC arbitration concerning telecommunications assets in Myanmar.
- Representing a leading alternative asset manager in three consolidated SIAC arbitrations against a publicly listed Indian company involving investments in a company valued at approximately US$ 1.3 billion and alleged contraventions of Indian FDI regulations.
- Advising an Indonesian power company in respect of disputes with a Korean contractor involving the operation of force majeure provisions, extensions of time claims, and claims for prolongation costs.
- Acting for a private equity firm in respect of the termination of its relationship with a developer in connection with a US$ 350 million investment in a highly regulated industry in Taiwan.
- Representing a financial institution in proceedings in the Singapore International Commercial Courts concerning the termination provisions of an ISDA Agreement.
- Defending claims in the Singapore courts concerning alleged breaches of trust (including alleged failures to obtain a reasonable return for the trust) in respect of a portfolio of more than US$ 700 million in assets.
- Defending claims of minority oppression in the Singapore courts in respect of company valued at more than S$ 100 million.
